Abstract: O direito fundamental ao processo justo contém a necessidade de prestação jurisdicional adequada. Para que a prestação jurisdicional possa ser adequada são necessários mecanismos que adaptem a tutela buscada ao tempo de sua prestação. O procedimento comum, ordinário ou sumário, não responde mais de forma satisfatória aos anseios daqueles que buscam o judiciário, principalmente em virtude de sua incompatibilidade temporal aos casos urgentes. A distribuição do ônus do tempo entre as partes foi uma solução encontrada para adaptar a prestação jurisdicional a tutela buscada. Para adequar o tempo inerente ao desenvolvimento do processo às tutelas urgentes desenvolveram-se formas de parcialização da lide com possibilidade de antecipação da tutela. Dentro dessa perspectiva, as tutelas urgentes precisam de medidas expeditas para sua efetivação. Contudo, atualmente não há, na legislação, uma medida adequada a proteger as situações urgentes que se mostrem irreversíveis e definitivas. O § 2º do art. 273 do CPC é expresso ao vedar a possibilidade de antecipação quando há risco de irreversibilidade. Apesar desse requisito negativo, a proteção é feita de forma inadequada através da antecipação de tutela. Ante a essa situação, mostra-se prudente o desenvolvimento de uma medida própria, adequada à tutelar situações urgentes e irreversíveis.
The fundamental right of the due process contains the need for granting the proper judgment. The mechanisms that adjust the sought-after legal protection to the time of the granting are necessary so that the granting of judgment is proper. The common, ordinary or final procedures do not meet satisfactorily the demands of those who seek legal help, especially, because of the temporal incompatibility with urgent cases. The distribution of the burden of time between the parties was a solution found to adapt the granting of judgment to the sought after protection. The manners of partializing an action with a possibility of anticipating the protection have developed to adjust the period of time inherent to the development of the action to urgent cases of protection. Within this context, the urgent cases of legal protection need expedite measures to come into effect. However, at present, there is no proper measure in law to protect urgent situations that appear to be irreversible or definitive. § 2º of the article 273 of the Procedural Code is clear in prohibiting the possibility of anticipation where there is a risk of irreversibility. In spite of this negative requirement, the protection is carried out in an improper manner by anticipating the legal protection. Therefore, considering this situation, the development of a proper measure adequate for handling urgent and irreversible situations appears to be reasonable.
