| Resumo: | A presente dissertação enfoca a influência do tempo no processo penal na busca de uma política de redução de danos, sob a perspectiva da preservação da Dignidade da Pessoa Humana. Dessa forma, passou-se pelo estudo do tempo objetivo e do tempo subjetivo, bem como da velocidade da sociedade e do tempo na prisão. Em seguida, analisa-se a Dignidade da Pessoa Humana e a influência da mídia no processo de estigmatização e desrespeito à Presunção de inocência realizada pelos meios de imprensa. Ao final, verificaram-se as possibilidades de se preservar a Dignidade da Pessoa Humana e evitar a estigmatização do indivíduo diante do processo penal, buscando-se reduzir os danos e reconhecendo-se a limitação do poder punitivo estatal diante do direito de ser julgado em um prazo razoável e da prescrição antecipada. Verificou-se, assim, o direito do réu ser processado em um prazo justo e o direito de ter extinta a punibilidade com base em uma hipotética pena, evitando-se, dessa forma, o desgaste desnecessário para o acusado e, também, para o Poder Judiciário. O tema foi abordado em três capítulos e utilizou-se o método analítico, por meio de uma pesquisa interdisciplinar de obras estrangeiras e nacionais. O estudo adequou-se a área de Concentração Violência, verificando a estigmatização e o sofrimento do acusado submetido ao sistema penal. Da mesma forma, utilizou-se a Linha de Pesquisa Política Criminal, Estado e Limitação do Poder Punitivo na Sociedade Contemporânea, na medida em que busca-se investigar alternativas para redução de danos causados pela violência empregada pelo sistema judiciário no processo penal.
The present dissertation focuses the influence of the time in the criminal proceeding in the search of one politics of reduction of damages, under the perspective of the preservation of the Dignity of the Person Human being. Of this form, it was transferred for the study of the objective time and the subjective time, as well as of the speed of the society and the time in the arrest. Afler that, it is analyzed Dignity of the Person Human being, the influence of the media in the estigmatization process and the disrespect to the Swaggerer of innocence carried through for the ways of the press. To the end, the possibilities of if preserving the Dignity of the Person Human being and ahead preventing the estigmatization of the individual of the criminal proceeding had been verified, searching to reduce the damages ahead and recognizing it limitation of the state punitive power of the right of being judged in a reasonable term and of the anticipated lapsing. It was verified, thus, the right of the male defendant to be processed in a stated period just and the right to have dead person the punshability on the basis of a hypothetical penalty, preventing itself, of this form, the unnecessary consuming for the defendant and, also, to be able it Judiciary. The subject was boarded in three chapters and used the analytical method, by means of a research to interdisciplinary of foreign and national workmanships. The study it was adjusted area of Concentration Violence, verifying the estigmatization and the suffering of the defendant submitted to the criminal system. In the same way, it was used line of Research Criminal Politics, State and Limitation of the Punitive Power in the Society Contemporary, in the measure where it searchs to investigate alternatives for reduction of actual damages for the violence used for the judiciary system in the criminal proceeding. |
