Abstract: The present dissertation’s intent, in connection with the Researching Line of Contemporary Criminal-Legal Systems, of the Postgraduate Studies Program in Criminal Sciences of the Pontifical Catholic University of Rio Grande do Sul, is to analyze the controversy about the legitimacy of the free competition’s criminal tutelage under the approach of the subsidiarity. Although there is a consensus about the valorative importance of the free competition’s legal interest in the Brazilian political-economic model, to the point of deserving a protection under the Criminal Law, the theme of such controversy comes across some divergences, mainly by reason of the protection provided to such legal interest by means of the sanctioning Administrative Law (CADE). Several are the voices uttered in the sense that a greater efficiency of the administrative protection would lead to the illegitimacy of the criminal protection based on the principle of subsidiarity. So as to carry out the analysis of such a critic, a study is made on the axiological valuation of the free competition, and on the ways its protection is being conferred in the realm of the Brazilian juridical system and in the compared law. The objective was exactly making a comparative analysis, so as to approach the question of the necessity of the criminal tutelage. In this specific point, besides a conceptual approach of the principle of subsidiarity, clearly interconnected with the principle of necessity, it has been noticed that the parameter of efficiency, although being important for measuring the lack of criminal tutelage in the realm of the secondary Criminal Law, cannot be seen as sufficient for leading to the decriminalization of the free competition’s criminal tutelage, in face of its axiological valuation and of the differentiation of functions between the Administrative Law and the Criminal Law. Finally, in order to turn the juridical-criminal intervention of the free competition in accordance with the ultima ratio principle, some criteria are proposed, which may lead to the its reduction to the core of offenses that seem to be more intolerable to the legal interest.
A presente dissertação, vinculada à Linha de Pesquisa Sistemas Jurídico-Penais Contemporâneos, do Programa de Pós-Graduação em Ciências Criminais da PUC/RS, busca analisar a controvérsia acerca da legitimidade da tutela penal da livre concorrência, especialmente sob o enfoque da subsidiariedade. Embora haja consenso acerca da importância valorativa do bem jurídico livre concorrência no modelo político-econômico brasileiro, a ponto de merecer uma proteção por meio do Direito Penal, a temática da carência dessa tutela encontra divergências, especialmente em razão da proteção conferida a esse bem jurídico por meio do Direito Administrativo sancionador (CADE). Diversas são as vozes que soam no sentido de que a maior eficiência da tutela administrativa conduziria à deslegitimidade da tutela penal com base no princípio da subsidiariedade. Para empreender a análise dessa crítica, realiza-se um estudo acerca da valoração axiológica da livre concorrência e das formas como vem sendo conferida sua tutela no âmbito do ordenamento jurídico brasileiro e no direito comparado. O objetivo foi, justamente, realizar uma análise comparativa para adentrar na questão da necessidade da tutela penal. Neste ponto específico, além de uma abordagem conceitual do princípio da subsidiariedade, nitidamente imbricado com o princípio da necessidade, constatou-se que o parâmetro da eficiência, embora seja importante para aferir a carência de tutela penal no âmbito do Direito Penal secundário, não pode ser visto como suficiente para conduzir à descriminalização da tutela penal da livre concorrência, em face da sua valoração axiológica e da diferenciação de funções entre o Direito Administrativo e o Direito Penal. Por fim, objetivando tornar a intervenção jurídico-penal da livre concorrência consentânea com o princípio da ultima ratio, propõe-se alguns critérios para sua redução ao núcleo de ofensas que se mostrem mais intoleráveis ao bem jurídico.
