| Abstract: | O presente trabalho objetiva (des)velar os efeitos jurídico-penais da Lei de Drogas, frente ao encarceramento feminino na Penitenciária Feminina Madre Pelletier, através de pesquisa envolvendo a legislação e jurisprudência aplicáveis, análise de processos de execução criminal, prontuários e entrevistas, de modo a propor alternativas viáveis. Busca-se, ainda, tornar possível compreender que o fenômeno do proibicionismo criminalizador, perceptível através da hipercriminalização e dos enrijecidos recrudescimentos penais, destinados indistintamente às mulheres encarceradas pela comercialização das drogas ilegais, não só tem se demonstrado inócuo como ainda mais prejudicial. Somam-se a tais fatores as facetas exploradas pela Lei 11. 343/06, a qual destina tratamento preventivo aos consumidores de drogas e excessivamente repressor aos varejistas, o que pode ser perceptível desde a generalizada (im)possibilidade de benesses legais aos traficantes até o incremento da pena mínima abstratamente cominada a eles.
This paper aims to (un) veil legal effects of criminal drug laws, in front of female incarceration in the Women's Penitentiary Madre Pelletier, through research involving law and jurisprudence applicable, analysis of criminal enforcement proceedings, records and interviews order to propose viable alternatives. Search is also becoming possible to understand the phenomenon of criminalization Prohibition, visible through the hyper criminalization and hardened criminal upsurge intended equally to women imprisoned for selling illegal drugs, not only has proved safe and even more damaging. Added to these factors facets explored by Law 11. 343/06, which aims preventive treatment for drug and excessively repressive retailers, which may be noticeable from the general (im) possibility of legal bounty to dealers to increase the minimum penalty abstractly restraint applied to them. |
