| Resumen: | Este trabalho busca analisar a perspectiva de atuação da Advocacia-Geral da União na representação jurídica do Estado Brasileiro nos foros internacionais, conjuntamente com a representação prioritariamente política afeta ao Ministério de Relações Exteriores. Neste particular e especificamente, este trabalho trata do Órgão de Apelação da Organização Mundial do Comércio, Organização esta que - verdadeiramente instância quasi jurídica - pós 1995, regula, supervisiona e garante aos seus Estados-membros segurança na administração e controle das relações comerciais internacionais. Apesar de sua relevância, é tema ainda recente e praticamente inexplorado em solo brasileiro. Neste sentido, adota-se como objeto o estudo doutrinário em torno da própria Organização Mundial do Comércio e de seu Órgão de Apelação. Como conclusão, este trabalho apresenta a conveniência e a constitucionalidade da representaçao do Estado brasileiro, na órbita jurídica ou quasi jurídica dos foros internacionais - além de sua regular representação diplomática - também ser feita pela Advocacia-Geral da União, considerando-se o ordenamento jurídico brasileiro, as atribuições e prerrogativas do profissional Advogado e o adensamento da juridicidade nas relações internacionais nos últimos anos, tendo em vista a Advocacia tal como posta na Constituição da República Federativa do Brasil, de 05 de outubro de 1988.
This work analyzes the perspective os action of the General-Advocacy of the Union (Advocacia-Geral da União) in the legal representation in the international forums, of the Brazilian State, jointly with the political representation affected to the State Department of Foreign Relations. Specifically and in this particular, this work deals with the Appelate Body of the World Trade Organization (WTO), Organization that - truly quasi legal instance - after 1995, regulates, supervises and guarantees to his States-Members security in the administration and control of the international commercial relations. Despite of his relevance, the subject is recent practically unexplored in Brazil. In this sense, the subject adopeted in this work is the doctrinary study around the World Trade Organization itself and his Appelate Body, also under the aspect of the vision of theme proposed, in face of the Constitution of the Federative Republic of Brazil, of October 05th. of 1988. As conclusion, this work presents the the convenience and the constitutionality for the representation of the Brazilian State - besides his regular diplomatic representation - in the legal or quasi legal orbit of the international forums, also to be made by the General-Advocacy of the Union (Advocacia-Geral da União), considering the Brazilian legal ordering, the attributions and prerogatives of the professional Lawyer (in this case Attorney) and the thickening of judiciality in the international relations along the last years. |
