| Resumen: | Este trabalho apresenta os resultados da pesquisa realizada acerca da atuação do sindicato na concretização dos direitos de natureza previdenciária dos trabalhadores empregados. Objetiva-se demonstrar a importância do trabalho para o ser humano e a sua estreita vinculação com a questão dos direitos fundamentais, enfatizando-se o princípio da dignidade humana, com ênfase no estudo do direito fundamental à previdência. Partindo-se de aspectos históricos pertinentes à tutela do trabalho humano, assim como do estudo doutrinário e do arcabouço legislativo compreendendo Direito do Trabalho, Direito Coletivo do Trabalho e Direito Previdenciário, suas nuanças, suas normas e o entrelaçamento entre elas, busca-se identificar a presença de espaços para a participação do sindicato, como representante de empregados – em atividade e aposentados - e empregadores, no âmbito da Previdência Social brasileira, considerada sua estruturação e gestão democrática e descentralizada. A identificação da realidade, a partir e pesquisa documental e de campo, junto a entidades sindicais, complementam o estudo, permitindo detectar perspectivas e tendências de ampliação da atuação sindical nesta seara, na medida que a efetivação dos direitos previdenciários do trabalhador não há de ser exigida apenas do Estado, comprometendo-se com ela toda a sociedade. Examinam-se as alterações e reformas constitucionais e legais pertinentes, especialmente no que tange ao reconhecimento das centrais sindicais, que, de fato, já assumem grande parte do diálogo social mantido no âmbito dos órgãos colegiados da Previdência Social, propiciador da atuação concretizadora objeto do presente estudo.
This work presents the results of the research carried through concerning the performance of the union in concreting the rights of welfare nature of the employed workers. It aims to demonstrate the importance of the work to the human being and its narrow entailing with the question of the fundamental rights, emphasizing the principle of the human being dignity, with emphasis in the study of the fundamental right to the welfare. Starting from the pertinent historical aspects to the guardianship of the human labor, as well as of the doctrinal study and outline legislative including Labor Law, Collective Labor Law and Welfare Law, its nuances, its norms and the interlacement between them, one searches to identify the presence of spaces for the union participation, as the employee’s representative - in activity and pensioners - and employers, in the scope of the Brazilian Social Welfare, considered its structuring and democratic and decentralized management. The identification of the reality, from a documentary and field research, together with entities of the Union, complement the study, allowing to detect perspectives and trends of magnifying of the Union performance in this party, as the effectiveness of the welfare rights of the worker does not have to be demanded only of the State, committing themselves to it all the society. The legal alterations and pertinent reforms are examined constitutional and, especially in what it refers to the recognition of the Union central offices, that, in fact, already assume great part of the social dialogue kept in the scope of the collegiate agencies of the Social welfare, provider of the solid performance of this present study object. |
