Tomada de depoimento especial de crianças e adolescentes em situação de abuso sexual: desafios à intervenção profissional do assistente social na perspectiva da garantia de direitos

Abstract

A presente dissertação propôs-se a conhecer como vem se constituindo o trabalho do assistente social junto à tomada de depoimento especial de crianças/adolescentes vítimas de violência sexual, aplicado no Poder Judiciário brasileiro, bem como as percepções dos atores sociais envolvidos neste processo. Apresentou comoobjetivos específicos: (a)Identificar como os assistentes sociais, quando da realização do Depoimento Especial, percebem a articulação desta atividade com os fundamentos teórico metodológicos, ético-políticos e técnicos operativos da profissão; (b) Verificar como as crianças e adolescentes, vítimas de violência sexual e ouvidas pelo Depoimento Especial experienciam esta abordagem; (c)Caracterizar as percepções que responsáveis e técnicos da rede têm em relação a esta prática alternativa de tomada de depoimento especial; (d) Identificar quais as instâncias da rede que as crianças/adolescentes passaram antes de serem ouvidas pelo Depoimento Especial e como foi este processo de relato da experiência de abuso sexual anteriormente a esta escuta especial. Constituiu-se em uma pesquisa qualitativa, sendo o processo de investigação fundamentado pelo método dialético crítico. Os principais resultados encontrados apontam que:a) a intervenção do assistente social na tomada de Depoimento Especialé pautada pelos pressupostos ético-político, teórico metodológico e técnico operacional da profissão; b) a capacitação para atuar junto ao Depoimento Especial é imprescindível; c) a interdisciplinaridade é necessária na atuação junto ao Depoimento Especial; d) a autonomia profissional está preservada na atuação junto ao Depoimento Especial; e) o Depoimento Especial configura-se como uma prática de redução de dano; f) o Depoimento Especial é a forma alternativa preferencialmente eleita pelos atores sociais; g) As vítimas relatam que a experiência do Depoimento Especial foi permeada pelo respeito, escuta e possibilidade de alívio de tensão ao expor os sentimentos decorrentes do abuso sofrido; h) a violência sexual infantil é um fenômeno que ocorre em todas as classes sociais; i) a tomada de depoimento na justiça não ocorre somente com as crianças ou adolescentes de famílias mais pobres, com baixo nível cultural ou de escolaridade; j) a tomada de depoimento da criança ou adolescente vítima de violência sexual deve ser feito quando da notificação do abuso. Analisar como vem se constituindo o trabalho do assistente social junto à tomada de depoimento especial de crianças/adolescentes vítimas de violência sexual contribui não apenas para ampliar o debate sobre o projeto ético-político profissional como também propor ações na defesa, proteção e garantia dos direitos da criança e adolescentes, vítimas de violência sexual.

This dissertation sets out to learn how social workers are intervening in the process of the deposition of special testimony with children / adolescents victims of sexual violence, applied in the Brazilian Judiciary, as well as perceptions of social actors involved in this process. It has the following objectives: (a) Identify how social workers, when the completion of Special Testimony realize the articulation of this activity with the theoretical and methodological, ethical and political and technical principles of the profession, (b) Examine how children and adolescent victims of sexual violence are heard by the Special Testimony and how they experience this approach, (c) characterize the perceptions that managers and network professionals have about this alternative practice of making special deposition, (d) identify which instances of the network children \ teens experienced before being heard by the Special Testimony and how the process of reporting the experience of sexual abuse prior to this particular hearing was lived. It is a qualitative research based on the dialectical critical-method. The main results show that:a) the intervention of social workers in Special Testimony is guided by ethical and political assumptions, theoretical, methodological and technical-operational aspects of the profession, b) training to work with the Special Testimony is essential; c) the education is necessary in the performance in the Special Testimony d) professional autonomy is preserved in the action with the Special Testimony; e) Special Testimony appears as a practice of harm reduction; f) the Special testimony is the preferred alternatively approach elected by the stakeholders; g) Victims report that the experience of Special Testimony was permeated by respect, listening and possible relief of tension by exposing the feelings arising from the abuse suffered h) child sexual violence is a phenomenon that occurs in all social classes; i) the taking of testimony in court is not only in children or adolescents from poorer families, with low level of culture or education; j) the taking of testimony of the child or adolescent victims of sexual violence must be made upon notification of abuse. To analyze how social workers are developing their work with Special testimony of children / adolescents victims of sexual violence contributes not only to broaden the debate on the ethical-political professional project but also to suggest actions to defend, protect and guarantee the rights of children and adolescents victims of sexual violence.
