Tecendo redes de proteção para crianças e adolescentes: caminhos e descaminhos na construção de sujeitos de direitos

Abstract

O presente estudo apresenta como tema a Rede de Proteção da Criança e do Adolescente do município de Carazinho, tendo como contraponto a efetiva garantia dos direitos fundamentais das crianças e adolescentes preconizadas no Estatuto da Criança e do Adolescente. Debruça-se sobre a investigação de como a Rede de Proteção da Criança e do Adolescente do município vem se constituindo, na interface com a política da proteção integral, buscando contribuir com subsídios para o aprimoramento das políticas públicas voltadas para esta população. A pesquisa é de um estudo de caso, orientada pelo método dialético-crítico. As categorias teóricas que iluminaram a investigação foram Política de Proteção Integral, Crianças e Adolescentes como Sujeitos de Direito, Rede de Proteção da Criança e do Adolescente e Esfera Pública. No trabalho, utiliza-se uma abordagem qualitativa, que visa um estudo aprofundado do significado da Rede de Proteção da Criança e do Adolescente para os atores sociais e públicos que a integram. Ao longo da pesquisa, foram analisadas as dimensões político-ideológicas que norteiam a organização e funcionamento dessa rede, identificando seus valores, princípios e diretrizes legais, e verificando em que medida se traduzem na direção da efetivação do ECA.Analisa-se, também, como vêm sendo operacionalizados os programas, projetos e serviços de atendimento às crianças e adolescentes e qual o significado dessa rede na experiência social das crianças, adolescentes e famílias atendidas. Como principais resultados, o estudo aponta para a forte contradição na constituição da Rede de Proteção da Criança e do Adolescente de Carazinho, a partir de avanços e retrocessos no campo da afirmação dos direitos infanto-juvenis. O reconhecimento de crianças e adolescentes como sujeitos de direitos é garantido no âmbito jurídico formal, mas ainda precisa ganhar consistência no campo concreto de atendimento a essa população. A referência ao campo dos direitos para esse segmento persiste atrelada ao atendimento de necessidades, sinalizando que ainda se está no meio do caminho da adoção de um paradigma da garantia de direitos fundamentais e proteção integral. A integração entre os eixos da promoção, defesa e controle social que constituem o Sistema de Garantia de Direitos da Infância e Juventude está sendo estruturada a partir do compromisso político dos atores sociais, mas ainda precisa ganhar corpo no interior da rede de proteção. As dificuldades, nesse âmbito, apontam para a importância do fortalecimento da esfera pública. A avaliação do trabalho, na perspectiva de redes, torna-se relevante, na medida que pode subsidiar indicativos importantes para a instrumentalização dos atores que as operam, desvelando limites e possibilidades desse trabalho, na direção da efetiva cidadania de crianças e adolescentes.

The research is of a case study, guided by the dialect -critical method. The theoretical categories that illuminated the investigation they were Political of Integral Protection, Child and of Adolescent as Subject of Right, Net of Protection of the Child and of Adolescent and Public Sphere. In the paper, a qualitative approach is used, that seeks a deepened study of the meaning of the Net of Protection of the Child and of Adolescent for the social and political sections that integrate her. Along the research, they were analyzed the political-ideological dimensions that they orientate the organization and operation of that net, identifying your values, beginnings and legal guidelines, and verifying in that measured if they translate in the direction of executing of ECA. It is verified, also, as it has been executed the programs, projects and attendance services to the children, adolescents and which the meaning of that network in the children's social experience, adolescents and assisted families. As principal results, the study appears for to strong contradiction in the constitution of the Netwoark of Protection of the Child and Adolescent of Carazinho, starting from progresses and non progresses in the field of the statement of the childhood-youth rights.The children's recognition and adolescents as subject of rights it is guaranteed in the formal ambit, but still needs to win consistence in the concrete field of attendance the that population. The reference to the field of the rights for that segment persists harnessed to the attendance of needs, signaling that is been still in the middle of the road of the adoption of a paradigm of the warranty of fundamental rights and integral protection. The integration among the axes of the promotion, defense and social control that constitute the System of Warranty of Rights of the Childhood and Youth is being structured starting from the social actors' political commitment, but still needs to win body inside the protection net. The difficulties, in that sense, appear for the importance of the invigoration of the public sphere. The evaluation of the work, in the perspective of networks, becomes important, in the measure that can subsidize indicative important for the actors' tools that operate them, watching limits and possibilities of that work, in the direction of the effective citizenship of children and adolescents.
