O conceito de sociedade civil em Kant

Abstract

A presente pesquisa tem em vista analisar a filosofia política kantiana a partir de seus escritos sobre o direito na obra Doutrina do Direito. Desse modo, começa por um minucioso estudo sobre o estado de natureza, entendido, em termos kantianos, por direito privado, para, posteriormente, introduzir nossa atenção no conceito de sociedade civil. O desenvolvimento da pesquisa gira em torno da propriedade e do contrato, noções usadas para intermediar a relação entre direito natural e direito positivo, este último encontrado somente no direito público quando regido por leis jurídicas. O conceito de posse jurídica sob o estatuto do direito também será analisado, pois esse conceito apresenta, de forma mais evidente, as diferenças jurídicas que perpassam desde o estado de natureza privado de leis até o Estado político formado pela sociedade civil. Kant identifica o ser racional como aquele capaz de autolegislação e dotado de uma liberdade inata. No entanto, apesar de todos possuírem liberdade mesmo no direito privado, Kant chama a atenção para a necessidade dessa liberdade se converter em liberdade externa no âmbito político, com o intuito de impedir que haja abuso da liberdade de um e outro. A sociedade civil não possui somente o direito que interfere na liberdade de todos de modo a preservar as regras jurídicas na sociedade, contudo, engloba cidadãos que têm que ser conduzidos para uma melhor organização coletiva.

This research aims to analyze the Kantian political philosophy from his writings about the law in the work Doctrine of Right. Thus, it begins by a thorough study about the state of nature, understood, in Kantian terms, as general law, to then introduce our attention on the concept of civil society. The development of the research revolves around property and contract, notions used to intermediate the relationship between natural law and positive law, the latter found only in public when governed by juridical laws. The concept of juridical ownership under the statute of law will also be examined, as this concept presents, in a more evident way, the juridical differences that permeate from the state of private nature of laws to the private political State formed by civil society. Kant identifies the man as a rational being capable of self-legislation and gifted with an innate freedom. However, despite all having freedom even in the private law, Kant draws attention to the need of this freedom to turn into an external freedom in the political sphere, in order to prevent the abuse of the freedom of one and another. The civil society not only has the law that interferes with the freedom of everyone in order to preserve the rules of law in Society, however, encompasses citizens that have to be conducted to a better collective organization.
