| Resumen: | Trata-se de estudo que visa promover uma reflexão acerca da dignidade da pessoa como fundamento dos direitos fundamentos, voltando-se, mais especificamente, para a sua eficácia nas esferas das relações jurídicas de cunho privada. A relevância do tema encontra-se na ausência de dogmática acerca da eficácia desse valor fundamental na esfera particular, reinando a mais absoluta indeterminação que, muitas vezes, promove o comprometimento do seu conteúdo axiológico. O objetivo desse trabalho foi delimitar, através de uma análise histórica, hermenêutica e filosófica da dignidade da pessoa humana, quais os valores que devem preponderar na sua aplicação, mormente no âmbito privado. O desenvolvimento do trabalho foi viabilizado por meio de pesquisa bibliográfica, envolvendo doutrina jurídica e filosófica acerca do tema. No decorrer do estudo, tivemos a oportunidade de investigar as origens do Direito Privado, analisar a aquisição do status de sujeito de direitos pela pessoa, de fazer a distinção entre autonomia da vontade e autonomia privada, analisar a intersecção entre direito privado e direito fundamentais, assim como estabelecer um panorama histórico evolutivo da dignidade da pessoa humana, bem como dos seus elementos de cunho filosófico a partir de Kant e Rawls, para delimitar os parâmetros éticos que devem condicionar a sua efetivação entre os particulares. Como resultado da pesquisa, concluímos que a efetivação da dignidade da pessoa humana no âmbito das relações jurídicas privadas, não se submete a parâmetros específicos, principalmente, aqueles que atribuam aos titulares de direitos no exercício da autonomia da autonomia de assumir um compromisso ético com a própria dignidade.
This is a study which aims to promote a reflection about human dignity as the foundation of fundamentals rights, geared, specifically, to its effectiveness in the spheres of legal relations of a private nature. The relevance of the issue lies in the absence of dogmatic about the effectiveness of this fundamental value in the private sphere, the reigning absolute indeterminacy that often promotes the commitment of its axiological content. The aim of this study was to delimit, through a historical analysis, philosophical hermeneutics and the dignity of the human person, which values should prevail in its implementation, especially in the private sector. The development of this work was made possible by means of literature, involving legal and philosophical doctrine on the subject. During the study, we had the opportunity to investigate the origins of Private Law, examine the acquisition of rights by the person subject to status, to distinguish between freedom of choice and personal autonomy, analyze the intersection between private law and fundamental rights, as well as establishing an evolutionary historical overview of human dignity, as well as their philosophic elements from Kant and Rawls to define the ethical parameters that should condition its effectiveness among individuals. As a result of the research, we concluded that the realization of human dignity in the context of private legal relations, is not subject to specific parameters, especially those who assign the rights holders in the exercise of autonomy to assume an ethical commitment to dignity. |
