| Abstract: | O presente trabalho analisará o Processo Penal Militar sob o prisma do seu ritual, tendo como objeto empírico a sessão de julgamento de um soldado. Irá perquirir a função do ritual como mecanismo de contenção ou não da violência institucionalizada (Processo Penal Militar) e limitação do poder punitivo. Os princípios de “disciplina” e “hierarquia” constituem a base institucional das Forças Armadas e são seus alicerces sociais e estruturais. A pesquisa parte de uma reflexão que se questiona se estes princípios estão presentes na sessão de julgamento de um soldado. Nesse sentido, focalizou-se a encenação ritualística de um julgamento da Justiça Militar da União. Investigando a função e a presença dos princípios da disciplina e hierarquia nas Forças Armadas e no Processo Penal Militar, tendo como base a observação da sessão de julgamento, concluiu-se que não há como definir precisamente ou interpretar de forma absoluta o ritual, tendo em vista, as inúmeras definições dos autores trabalhados e do que se espera do rito em determinada fase. O oficial militar (Juiz-Militar) na caserna é submetido a um rito de passagem, separando física e simbolicamente a vida anterior (civil) e a nova vida (Militar). O soldado a um rito de ordem para fabricação de corpos dóceis retira o máximo de suas forças através de uma hierarquia para alcançar o fim que é a disciplina. No ritual específico contido no Processo Penal Militar há uma (re)estruturação da ordem quebrada pelo cometimento de um crime por um soldado e a purificação por ter tido contato com o impuro. A hierarquia e a disciplina da caserna estão presentes no Processo Penal Militar, devido as suas particularidades, tais como, composição do órgão julgador por superiores hierárquicos, arquitetura, disposição espacial, posturas, honras, cerimônias, contenções, vestes e símbolos.A pesquisa, ao analisar o ritual judiciário militar, contribui, através do exercício de uma ótica interdisciplinar, para uma compreensão mais aprofundada das várias facetas que compõem o âmbito judicial militar.
The main objective of this research is to analyze Military Penal Process from a ritual perspective, having, as an empirical object, the session of a soldier’s judgment. We presented the ritual function as a mechanism that may or may not control institutionalized violence (Military Penal Process) and the limitation of punitive power. Discipline and hierarchy principles are the basis of Armed Forces as well as their social and structural basis. We reflected upon the principles that are in a soldier’s judgment session. We focused the ritualistic staging at a Union Military Justice judgment. We concluded, by the investigation of the function and the presence of discipline and hierarchy principles in the Armed Forces and the Military Penal Process, considering the observation of the judgment session, that there is not any chance to properly define and explain the ritual in an absolute way, taking into consideration the definitions of the authors and what we expected from the ritual in a particular phase. In the casernes, the military officer (Military Judge) has to undergo an entrance ritual, separating his/her physical and symbolic previous life (civil) as well as his/her new life (Military). The soldier follows a high command in order to build up submissive and exercised body taking the most out his/her strength through the hierarchy to achieve the ultimate goal that is discipline.In the specific ritual that is in the Penal Military Process, there is a reestructuration of the broken law when a crime is committed by a soldier and also the purification since he/her was in contact with something that was not clean. Hierarchy and discipline in the caserne are in the Military Penal Process, due to their particular aspects, such as the composition of the institution that is in charge of the judgment that are build up by hierarchical superiors, architecture, spatial disposition, attitudes, honor, ceremonies, containments, clothing and symbols. Through the analysis that was done about the judiciary military ritual and also through an interdisciplinary perspective, we concluded that there is a significant contribution in the understanding of the multiple aspects that shape the judicial military scope. |
