Ressocializar ou manter a ordem social: dilema entre os atores envolvidos na execução e aplicação das medidas socioeducativas privadas de liberdade

Abstract

O trabalho apresenta as transformações realizadas na legislação brasileira relativa aos diretos da criança e do adolescente, a partir do Código de Menores de 1927 até a promulgação do Estatuto da Criança e do Adolescente, em 1990. É feito um levantamento histórico sobre as políticas de atendimento à criança e ao adolescente no Brasil, contextualizando a reestruturação da FEBEM após a criação do ECA. Por fim, o foco da pesquisa está voltado para o conhecimento das formas de inserção dos atores envolvidos com a ressocialização dos adolescentes infratores e de suas experiências profissionais e para as tensões e conflitos existentes entre esses atores relacionados com a problemática da ordem e segurança da instituição e da sociedade. Também foi analisada a concepção que os funcionários da FEBEM e os juízes da Infância e da Juventude têm sobre a ressocialização dos adolescentes infratores.

The present work is focused on the transformations occurred on brazilian law regarding children and teenagers rights since the Minor´s Code of 1927 until the enactment of Childrens and Teenagers Statute in 1990. For such purpose it was necessary to analyse historically the policies regarding children and teenager protection in Brazil with special attention to FEBEM´s structure after the enactment of the Childrens and Teenagers Statute of 1990. The main purpose of the survey is to clarify the means of integration of those who are directly involved on juvenile delinquent´s social reintegration combined with their professional experiences relatively to the pressures and conflicts that arise among those who deal with FEBEM´s security and the social security itself. Furthermore, it was also analysed the understanding of teenager rehabilitation from the perspective of FEBEM´s staff and the judges of Juvenile Courts.
