| Abstract: | Vive-se em um Estado Socioambiental e Democrático de Direito, onde a degradação ambiental é incontestável. Diversos são os problemas existentes em razão da falta de cuidado com o meio ambiente. O homem, cada dia mais individualista, e menos preocupado com a consequência de seus atos, precisa mudar seu posicionamento. O motivo dessa mudança pode ser qualquer um, já que incutir valores em uma sociedade cada vez mais consumista e preocupada com os bens materiais demorará mais tempo do que o planeta terra pode suportar. Atualmente, muito se fala de direito e pouco de fala de deveres. Todos querem garantir aquilo que lhes é de direito, sem se preocupar, todavia, em como deve colaborar para que esses direito sejam efetivamente garantidos, não só para si próprio como para toda a sociedade. O presente estudo, partindo da realidade atual, pretendeu demonstrar a importância assumida pelos dos deveres na forma estatal escolhida. Dentre esses deveres, destacou-se o dever fundamental de pagar tributos e sua necessidade não só como fonte de receita estatal, mas também como indutor de comportamento. Dentro desse contexto, analisou-se a tributação ambiental e a sua importante função na proteção do meio ambiente.O principal objetivo foi, através de uma interpretação sistemática, demonstrar que todos têm o dever de contribuir para a preservação do meio ambiente, legitimando a cobrança de tributos daqueles que têm posturas ambientalmente erradas e a concessão de favorecimentos àqueles que adotam comportamentos favoráveis ao meio ambiente. Lembra-se, contudo, que não se pretendeu defender mais uma forma de arrecadação governamental em um Estado em que a carga tributária já é considerada elevada, mas sim defender um meio desesperado de conter os avanços da degradação em um planeta que necessita disso para sobreviver.
We live under Rule of Law in a Democratic Social and Environmental State, where the environmental degradation is unquestionable. There are different problems caused by neglecting environment. Man, who is increasingly individualist and less concerned about the consequences of his actions, needs to change his position. The reason for this change could be anything, since instilling values in an increasingly consumer society and concerned with the material good will take longer than the Planet Earth can bear. Nowadays, a lot is said about rights and little about duties. Everyone wants to ensure what they are entitled to, without worrying about how to contribute to really ensuring these rights, not only to themselves but to the entire society. Using the present reality as a starting point, the goal of the study was to show the importance assumed by the duties in the chosen form of State. Among these duties, was prominent the fundamental duty of paying taxes and its necessity not only as a source of revenues for the State but as a tool for inducing behavior. In this context, the environmental taxation and its importance function in the environmental protection were analyzed. The main goal was to show by means of systematic interpretation that everyone has a duty to contribute to the preservation of the environmental, justifying the taxation of those who have environmentally wrong attitudes and the benefits granted to those who adopt behavior favorable to the environment.We should bear in mind however that we do not aim at defending another way of governmental taxation in a State where the tax burnden is already considered as high, but at defending a desperate way of stopping the uncontrollable degradation on a planet that needs it to survive. |
