| Abstract: | Este trabalho discorre acerca do direito fundamental de propriedade e do direito social à moradia, buscando estabelecer um diálogo entre estes importantes institutos. As alterações acerca do direito de propriedade urbana imóvel, a inclusão do direito à moradia dentre os direitos sociais e a edição da Lei Federal n°. 10. 257, de 10 de julho de 2001, que regulamenta os artigos 182 e 183 da Constituição da República Federativa do Brasil de 1988, denominada de Estatuto da Cidade, inauguram uma nova fase no tratamento do direito de propriedade, estabelecendo novos contornos a esse instituto tradicionalmente patrimonialista. Esses novos parâmetros legislativos disponibilizam importantes instrumentos urbanísticos que proporcionam ao Poder Público mecanismos para a efetivação do desenvolvimento das cidades, garantindo a função social da cidade e da propriedade urbana imóvel com o objetivo de atingir o desenvolvimento sustentável e o bem-estar de seus habitantes e, via de regra, o exercício do direito social à moradia adequada. A concretização da função social da propriedade urbana imóvel nos termos da legislação constitucional, civil e urbanística vigente representa, de fato, o pressuposto de admissibilidade para o reconhecimento do efetivo desenvolvimento sustentável, que, segundo a ordem mundial, tem no cidadão o centro das preocupações e, por objetivo, garantir a ordenação das cidades por meio da erradicação da pobreza, da redução das desigualdades sociais e pela implantação e implementação de políticas públicas habitacionais para melhorar a qualidade de vida dos cidadãos. Nesse contexto, investiga-se, à luz dos parâmetros legais, doutrinários e jurisprudenciais, a compreensão do direito à moradia, sobretudo, quando em colisão com o direito de propriedade.
This work talks about the fundamental right of property and the social rigth of dwelling, seeking to establish a dialogue about these important institutes. The changing related to the right of the urban real property, the inclusion of the housing rights among the social rights and the edition of the Federal Law n°. 10. 257, on July 10th, 2001, that regulates the article 182 and 183 in the Constitution of the Federative Republic of Brazil in 1988, called statute of the city, was launched a new phase of the property rights, establishing new outlines to this institute, traditionally materialist. These new legislative parameters make up important urban instruments that provide mechanisms to the public power to the effectuation of city development ensuring the city social function and the urban real property, in order to reach the sustainable development and welfare of its people, following the rules of the social right in terms of appropriate habitation. The social function concretion of urban real property on the present constitutional legislation, civil and town-planning actually represents the estimated of admissibility to recognition of the effective sustainable development, that, according to the world wide order, has the citizen as the center of concerns and, as an objective, guarantee the ordinance of the cities through poverty eradication, the social inequalities reduction and for the implantation and politics implementation of public housing to improve the citizens quality of life. In the context, it is investigated, according to the light of the legal, doctrinal and jurisprudential parameters, the understanding of the housing rights, especiallly when it is in collision with the real property right. |
