| Abstract: | In order to reflect on the Judiciary Power role in the Brazilian democracy and its level of engagement with the constitutional project initiated in 1988, this work sought elements from popular statements of the official memory about the performance of the Judiciary Power during the authoritarian period. The investigation suggests that the silence of the institutional narrative about the last authoritarian period provides a privileged space to identify that the Judiciary has actively collaborated in maintaining the authoritarian project, according to the weapons available to it, levelling its exercise of its functions when needed by the authoritarian regime. The research problem is confronted with the silence produced by the official memory. Within this boundary, the hypothesis used was that the traits of independence, impartiality, fundamental rights defence and control of constitutionality were carved as required by the authoritarian regime, with no official historiography of the Judiciary recording those movements. The goal to adopt this conducting line is to indicate that the same structures can also be moved in within diametrically diverse political contexts. At the end, the instrument of the research hypothesis suggests the existence of a Judiciary, whose practices in democracy can be just as or more authoritarian as those performed in an authoritarian regime.
A fim de refletir sobre as permanências autoritárias, a partir do papel do poder judiciário na democracia brasileira e seu grau de engajamento com o projeto constitucional inaugurado em 1988, este trabalho busca elementos a partir dos ditos e não-ditos na memória oficial sobre a atuação do judiciário durante o período autoritário. A pesquisa sugere que o silêncio da narrativa institucional, sobre o último período autoritário, fornece um espaço privilegiado para identificar que o judiciário colaborou ativamente na manutenção do projeto autoritário, conforme as armas de que dispunha, equalizando o exercício de suas funções ao exigido pelo regime autoritário. O problema de pesquisa é enfrentado a partir do silêncio produzido pela memória oficial. Dentro dessa margem e direcionando o enfoque para a narrativa do poder judiciário como instituição, opera-se a hipótese de que os traços de independência, imparcialidade, defesa dos direitos fundamentais e controle de constitucionalidade foram talhados conforme exigido pelo regime autoritário, sem que a historiografia oficial do judiciário registrasse esses movimentos. O objetivo de adoção desse fio condutor é indicar que as mesmas estruturas podem ser igualmente movimentadas em contextos políticos diametralmente diversos. Ao fim, a instrumentalização da hipótese de pesquisa sugere a existência de um poder judiciário, cujas práticas, em democracia, podem ser tão ou mais autoritárias quanto as desempenhadas em um regime autoritário. Aponta para a necessidade de correção de rumos da instituição, no intuito de extirpar seu núcleo autoritário estável, e para uma reflexão sobre o ensino do direito, questionando o grau de comprometimento que as Faculdades de Direito possuem com a democracia brasileira, a partir da forma como o direito é pensado e ensinado. |
