| Abstract: | A presente dissertação, vinculada à linha de pesquisa em Criminologia e Controle Social do Programa de Pós-Graduação em Ciências Criminais da PUCRS, pretende investigar o funcionamento do Juizado de Violência Doméstica e Familiar contra a Mulher do município de Porto Alegre, após a implementação da Lei 11. 340/2006. Por meio de um recorte de gênero, abrangendo os movimentos feministas e a criminologia crítica, o objetivo geral desse estudo é examinar como a referida legislação vem sendo aplicada e operacionalizada pelo juizado. Com ênfase na área criminal de sua competência, procura identificar os elementos que configuram as relações que chegam ao conhecimento do Poder Judiciário, e os impactos produzidos na vida da clientela majoritária. Busca-se focalizar um aspecto diferenciado, ao problematizar a dinâmica relacional dos atores envolvidos, considerando cada um deles como protagonistas de suas histórias. Ademais, questiona o sistema de justiça criminal, como reprodutor dos papéis hierarquizados de gênero e meio (in)adequado e (in)eficaz, tanto para cumprir suas promessas de segurança jurídica e controle da criminalidade, quanto para chegar aos resultados esperados pelas mulheres. Para que os objetivos fossem alcançados, confrontou-se a literatura investigada com a pesquisa de campo. As conclusões fundamentaram-se em dados estatísticos e em relatos das partes envolvidas. Trata-se de um estudo transdisciplinar, pois se entende que a temática da violência contra a mulher deve ser analisada por meio de uma visão globalizada, ou seja, pela convergência de várias perspectivas, sob a ótica de diversos olhares.
This present dissertation, linked with the line of research in Criminology and Social Control from the Post Graduation Program in Criminal Science of PUCRS, aims to investigate the operation of Domestic and Family Violence against Women Court (Judgeship) in the city of Porto Alegre, after the implementation of the Law 11. 340/2006. Through a consideration of gender, including some Feminist Movement and critical criminology, the general objective of this study is to examine how this legislation has been implemented and operationalized by the court. Emphasizing the area of its criminal jurisdiction, it tries to identify the elements that set the relations which are acknowledged by the Judiciary and also the impact it has in the lives of the majority of its customers. The aim is to try to focus on a different aspect, trying to understand the relational dynamic of the actors involved, considering each one as a protagonist of their own story. Furthermore, it questions the criminal justice system and its reproductive hierarchical roles being a little (in)adequate and (in)efficient, both to fulfill its promises of social pacification and control of violence, and as to achieve the results expected by women. In order for the objectives to be achieved, the literature investigated was confronted with the field research. The findings were based on statistical data and reports of the parties involved. This is a cross-disciplinary study and because of that, it is understood that the issue of violence against women must be analyzed by a global vision through the convergence of different aspects and views. |
