| Resumo: | Esta dissertação vincula-se à linha de pesquisa Política Criminal, Estado e Limitação do Poder do Punitivo, pois pretende-se discutir e sugerir propostas dogmáticas e político-criminais (teóricas e de lege ferenda) a fim de limitar o poder punitivo do estado nas questões envolvendo a eutanásia. Hodiernamente, o debate sobre a eutanásia ganha especial atenção, pois o avanço das ciências médicas possibilita a manutenção da vida em condições antes inimagináveis. Os avanços biomédicos lograram o aumento da expectativa e da qualidade de vida, contudo, esses progressos trouxeram consigo a obstinação terapêutica, na medida em que a vida tende a ser perseguida e prolongada a todo custo e a morte passou a ser vista como fracasso médico. O atual ordenamento jurídico não absorve essa complexidade de situações, nem oferece regulação jurídica satisfatória. Por isto, este trabalho tem o objetivo de avaliar através de uma abordagem interdisciplinar, a influência do progresso científico, tecnológico e cultural, no fenômeno da morte, bem como questionar a existência do direito de morrer dignamente nas situações eutanásicas e seu possível respaldo juríco.
This paper is associated to the research line Criminal Politics, State and Limitation of the Punitive Power. Therefore it is intended to discuss and to suggest politician-criminal proposals in order to limit the punitive power of the state in the questions involving euthanasia. Nowadays, the debate on the euthanasia gains special attention because the progress of medical sciences makes possible the maintenance of life in conditions that were unimaginable. The biomedical advances achived the increase of the expectation and of the quality of life, beside they brought the therapeutical stubbornness, in which life tends to be pursued and drawn out and the death is now seen as a medical failure. The current rules do not absorb this complexity of situations, nor it offers satisfactory legal regulation. For that reason, the aim of this work is to evaluate, through an interdisciplinary approach, the influence of the scientific, technological and cultural progress, in the phenomenon of death. Moreover, it aims at questioning the existence of the right to die with dignity in the different forms of euthanasia and its possible endorsement in the law. |
