Cooperação internacional e recursos hídricos: a formação de um regime internacional para o Aqüífero Guarani

Abstract

Esta pesquisa trata da cooperação internacional para o Sistema Aqüífero Guarani, objetivando buscar elementos que indiquem a possível formação de um regime internacional para a sua gestão. Os regimes internacionais são instituições com regras explícitas, acordadas entre os Estados, voltadas a uma área temática específica. Buscou-se saber, no caso do Aqüífero Guarani, se havia a existência de uma área temática delimitada, indícios de formalização de regras e convergência de expectativas dos atores estatais envolvidos, especialmente através do “Projeto de Proteção Ambiental e Desenvolvimento Sustentável do Sistema Aqüífero Guarani”. Em curso desde o ano 2000, com previsão de término para 2009, este Projeto envolve Argentina, Brasil, Paraguai e Uruguai através do financiamento do GEF e execução da OEA, tendo como núcleo a elaboração de um marco de gestão para o aqüífero, contendo aspectos legais, institucionais e técnicos, a ser disponibilizado aos países ao final de sua execução. Os resultados alcançados permitem inferir que se está em uma fase de formação da agenda de um regime internacional para o Aqüífero Guarani, fase em que já houve a emergência do tema mas que ele ainda não é um item prioritário da agenda regional a ponto das expectativas convergirem para a escolha de instituições para a sua gestão.

This research deals with the international cooperation for the Guarani Aquifer System, intendind to look for elements that indicate the possible formation of an international regime for its management. International regimes are institutions with explicit rules, agreed between the States, directed at a specific thematic area. It was searched to know, in the case of the Guarani Aquifer System, if it had the existence of a delimited thematic area, evidences of formal rules and convergence of expectations of the involved State actors, especially through the ‘Environmental Protection and Sustainable Development of the Guarani Aquifer System Project’. In course since year 2000, this Project involves Argentina, Brazil, Paraguay and Uruguay through the financing of GEF and execution of OEA, having as nucleus the elaboration of a framework for managing the aquifer, including legal, institutional and technical aspects, to be available to the countries at the end of its execution. The reached results allow to infer that it is in a phase of formation of the agenda of an international regime for Guarani Aquifer, phase in which it had already the emergency of the subject but it still is not a priority item of the regional agenda at the point of the expectations converge to the choice of institutions for its management.
