Os organismos geneticamente modificados em face da proteção constitucional ao meio ambiente

Abstract

Os organismos geneticamente modificados representam um novo desafio tecnológico para a sociedade, na medida em que caracterizam patamar de riscos que eleva a incerteza científica quanto a proteção do ambiente e da saúde humana. Os princípios gerais da Política Nacional de Biossegurança devem ser deduzidos de uma abordagem constitucional que possibilite a harmonização entre o desenvolvimento ecologicamente sustentável e biotecnologia, observado o respeito aos direitos fundamentais ao meio ambiente e à diversidade e integridade do patrimônio genético, a partir de afirmação ética da responsabilidade da pessoa humana pelo mundo em que vivemos.

Genetically modified organisms represent a new technological challenge for the society, in the measure in that characterize risk level that raises the scientific uncertainty about the protection of environment and human health. The general principles of National Biosafety Policy must be deduced of a constitutional approach that makes possible the harmonization between ecological sustainable development and biotechnology, with respect to the fundamental rights of environment and to the diversity and integrity of the genetic patrimony, from ethical affirmation of the human person’s responsibility for the world in that we lived.
