Modernidade, ambigüidade e direito civil-constitucional: da miragem da segurança à incerteza como imanência

Abstract

O presente trabalho apresenta as relações existentes entre o paradigma da modernidade a formação do Direito Civil brasileiro, buscando identificar a origem, as características e as conseqüências desta influência nos dias atuais, principalmente no que tange à busca pela certeza, para, posteriormente, dadas as alterações científicas ocorridas, sobretudo com relação às bases da modernidade, que acaba por incluir a incerteza imanente nos processos científicos, refletir sobre a necessidade de construção de alternativas novo-paradigmáticas, também ao Direito Civil, a fim de, em atendimento ao princípio da dignidade da pessoa humana, torná-lo vivo, includente e efetivo.

The present work presents lhe existing relations between the paradigm of modernity the formation of the Brazilian Civil law, searching to identify the origin, the characteristics and the consequences of this influence in the current days, mainly in what it refers to to the search for the certainty, for, later, given the occured scientific alterations, over all with regard to the bases of the modernity, that finishes for including the uncertainty imanente in the scientific processes, lo reflect on the necessity of construction of new alternatives, also to the Civil law, in order, in attendance at the outset of the dignity of pesssoa human being, to become the alive one, includente and cash.
