| Abstract: | O presente estudo tem como objetivo analisar, sob um olhar preponderantemente jurídico, questões pertinentes ao Direito de Visitas, hoje entendido como direito à Convivência Familiar, à luz da evolução do próprio Direito de Família, da Dignidade da Pessoa Humana e dos Direitos Fundamentais, enfatizando as mudanças operadas na situação da criança e do adolescente, especialmente em casos de ruptura do vínculo entre os genitores. Busca, ainda, demonstrar como os operadores do direito e áreas afins avançaram no tratamento dado à questão e analisa os mecanismos hoje disponíveis e a eficácia dos mesmos na garantia da efetividade desse Direito Constitucionalmente assegurado.
The present study aims at analyzing, from a legal point of view, questions concerning the right to visits, presently understood as the right to spend time with the family, taking into account the evolution of Family Law itself, the dignity of human beings and their fundamental rights. lt also emphasizes the changes in the law concerning children and adolescents, especially in the cases when the parents break ties. Furthermore, this study intends to demonstrate how Law professionals, as well as those from related areas, have improved their way to deal with this issue. Finally, it analyzes the mechanisms available nowadays - and their efficacy - to enforce this constitutionally guaranteed right. |
