| Abstract: | O presente trabalho visa identificar se a Operação Lava Jato, promovendo uma análise correlacionada às condenações do ex-Presidente Lula, foi alvo de lawfare. Referida prática é entendida como a manipulação do direito para atingimento de fins políticos, e promove, dentre outras consequências, a aniquilação de um inimigo. O trabalho percorreu as áreas de estudo do lawfare, seja na doutrina militar ou em contexto local. A pesquisa promoveu, ainda, o estudo de objetivos mais amplos decorrentes de sua prática relacionados à geopolítica e à expansão de uma agenda neoliberal na América Latina. Para identificação do lawfare, foram consideradas as dimensões propostas por COMAROFF, para o qual o lawfare, tal qual as guerras tradicionais, são caracterizadas pela existência de três dimensões: a geografia, o armamento e as externalidades. A geografia se perfaz na jurisprudência, corresponde ao campo de batalha onde ocorrerá o embate, identifica-se na Lava Jato uma manipulação da competência da Vara de Curitiba que enquadra a Operação nesta dimensão. O armamento são as leis, sobretudo as normas que tratam sobre corrupção, cujo teor prescreve conceitos e tipos penais amplos que facilitam sua adequação a diversos fatos. As externalidades dizem respeito a fatores externos que interferem na consecução do lawfare. Na Lava Jato a atuação da mídia, atuando na formação da opinião pública teve forte importância para a aplicação do lawfare. As conclusões do trabalho, na esteira dos recentes julgamentos do STF sobre a incompetência da Vara de Curitiba e a suspeição de Sergio Moro, corrobora que a Operação foi, na verdade, o caso mais completo de lawfare na contemporaneidade.
This paper aims to identify whether the Lava Jato Operation, specifically the Lula case, was a target of lawfare. This practice is understood as the manipulation of law to achieve political ends, and promotes, among other consequences, the annihilation of an enemy. The study covered the areas of lawfare, both in military doctrine and in the local context. The research also promoted the study of broader objectives arising from its practice related to geopolitics and the expansion of a neoliberal agenda in Latin America. To identify lawfare, we considered the dimensions proposed by COMAROFF, for whom lawfare, like traditional wars, are characterized by the existence of three dimensions: geography, weaponry, and externalities. The geography is made in the jurisprudence, corresponding to the battlefield where the clash will take place, it is identified in Lava Jato a manipulation of the jurisdiction of the Curitiba Court that fits the operation in this dimension. The weaponry are the laws, especially the rules that deal with corruption, whose content prescribes broad concepts and criminal types that facilitate their adaptation to various facts. The externalities refer to external factors that interfere in the achievement of the lawfare. In the Lava Jato case, the media's role in shaping public opinion was very important for the application of lawfare. The conclusions of the work, in the wake of the recent judgments of the STF on the incompetence of the Curitiba Court and the suspicion of Sergio Moro, corroborates that the Operation was, in fact, the most complete case of lawfare in contemporaneity. |
