Contrato e direito de propriedade: uma análise comparativa entre o direito e a nova economia institucional

Abstract

Este estudo teve como objetivo analisar a relação entre direito e economia, esta ultima representada pela teoria da Nova Economia Institucional (NEI). Para tanto, foram abordados dois institutos, o direito de propriedade e o contrato. A análise legal está focada nas bases estabelecidas pelo Código Civil de 2002, enquanto que a abordagem econômica focou nos preceitos da NEI, utilizando-se os conceitos e as idéias encontradas nos seus principais expoentes e, nas correntes da Economia dos Custos de Transação e na Teoria da Firma. Também se tentou demonstrar os pontos onde estas ciências se aproximam e aqueles onde se afastam, quando se referem aos institutos abordados.

This work aimed to examine the relationship between law and economics, the latter represented by the theory of New Institutional Economics (NIE). For this purpose, we dealt with two institutes, the property right and the contract. The legal analysis is focused on the basis established by the Civil Code of 2002, while the economic approach focused on the precepts of the NEI, using the concepts and ideas encountered in their main exponents, and in the Theory of Transaction Cost Economics and Theory of the Firm. It also attempted to show the points where these sciences are approaching and those where it depart from when they refer to this both institutes.
