Agentes da ditadura Argentina nos trilhos da justiça: embates diante de um processo crime de lesa humanidade

Abstract

Essa dissertação tem como objeto de análise um processo judicial argentino intitulado Expediente Nº 1-18. 239/04 Waern, Carlos Fidel y otros s/ supuesta Comisión Delito de Lesa Humanidad. Essa causa investigou se uma fazenda de criação de gado localizada em Paso de los Libres – Corrientes – Argentina serviu como prisão clandestina durante os anos do Processo de Reorganização Nacional (1976-1983). Os objetivos da pesquisa proposta nessa dissertação são: examinar as estratégias utilizadas na esfera jurídica no decorrer do processo; acarear acusação e defesa, versões, contradições e repetições nos autos do processo; e analisar a constituição da sociedade argentina, em âmbito social e institucional, após a restauração democrática. Este trabalho abrange a história desse processo e a história dos crimes investigados por esse processo. Além disso, versa sobre a Argentina democrática e os crimes de lesa humanidade, bem como sobre as ocorrências apuradas pela investigação judicial.

The subject of analysis of this dissertation is an Argentinean judicial process named Expediente Nº 1-18. 239/04 Waern, Carlos Fidel y otros s/ supuesta Comisión Delito de Lesa Humanidad. This cause investigated if a cattle farm located at Paso de los Libres – Corrientes – Argentina served as a military covert prison during the National Reorganization Process (1976-1983). The research objectives proposed here are: to examine the strategies used in the legal sphere during the process; to confront prosecution and defense, their versions, contradictions and repetitions in the process records; and to analyze the constitution of the Argentinean society, both on the social and institutional fields, after the democratic restoration. This work comprehends the history of this process and the history of the crimes investigates by it. Besides, it runs upon the democratic Argentina and crimes against humanity, as well as the events verified by the legal investigation.
