Judiciário, terra e racionalidade capitalista no Rio Grande do Sul (1889-1930)

Abstract

Esta tese tem por objetivo interpretar a problemática da propriedade da terra como mercadoria e objeto adotado pelo Estado e por frações de classe dominante arregimentada em torno dos governos castilhista-borgista no Rio Grande do Sul, entre 1889 e 1930, através do Judiciário como meio e agente, à racionalidade moderna capitalista. A análise foi conduzida de forma a perceber a relação de força e interesses econômicos de frações de classe no poder central com os poderes locais, no âmbito do Judiciário. Da confluência desses fatores, caracteriza-se a formatação do sistema alcançado pela elaboração, interpretação e aplicação das normas e da prática do Judiciário, no processo de formação do Estado e nele o lugar de frações de classe no aparelho estatal e na comunidade rural, cuja caracterização transita pela tentativa de apreensão da ambiguidade no esforço da elite dirigente de institucionalização da propriedade, do público e do privado, e, finalmente, das representações de poder no e do direito à terra pela interpenetração da justiça como via à racionalidade capitalista. No que concerne a esse último aspecto, constituem-se em foco da análise os códigos, as leis agrárias, as políticas públicas dirigidas à ocupação e colonização e os conflitos sociais refletidos em processos judiciais civis.

This thesis has the aim of interpreting the problematics of the property of land as a good and object adopted by the State and by fractions of the dominant classes around the castilhistaborgista governments in Rio Grande do Sul, between 1889 and 1930, having the judiciary as both means and agent, under the light of the modern capitalist rationality. The analysis was carried out so as to understand the relations of power and economical interests between fractions of the dominant classes of the central power and the local powers, within the judiciary power. The confluence of such factors characterizes the format of the system achieved through the elaboration, interpretation and application of the norms and practice of the judiciary, the process of State formation and, within it, the place of class fractions in the State apparatus and the rural community, whose characterization goes through attempts to aprehend ambiguity in efforts made by the ruling elite to institutionalize property, both public and private, and, finally, the representations of power at and of the right to the land through the interpenetration of justice as a path to capitalist rationality. As far as the latter is concerned, the analysis focused on the codes, agrarian laws, public policies towards the occupation and colonization and the social conflicts reflected on civil judicial processes.
