| Resumen: | Este trabalho tem como tema os desafios e limites dos mecanismos protetivos do direito à educação de crianças e adolescentes infrequentes nas escolas de Porto Alegre. O objetivo central que orientou o estudo foi analisar as possibilidades e os limites dos mecanismos protetivos do direito à educação de crianças e adolescentes institucionalizados através da FICAI – Ficha de Comunicação do Aluno Infrequente – a fim de contribuir para a garantia deste direito fundamental. A pesquisa realizada se caracteriza como um estudo exploratório e qualitativo, orientado pelo método dialético-crítico, que teve por base empírica a observação das reuniões do Fórum Permanente de Discussão da FICAI, a análise documental dos processos da FICAI com entrada no Ministério Público em março de 2007 e entrevistas com diferentes atores: crianças, adolescentes e familiares atingidos pela FICAI e profissionais participantes do Fórum. Os resultados da pesquisa apontam que a infrequência escolar de crianças e adolescentes é um fenômeno que traz consigo questões que muitas vezes são ocultadas – as situações de exclusão vivenciadas cotidianamente nas desigualdades sociais, no não acesso à satisfação de necessidades básicas de alimentação, saneamento, habitação e outras.A infrequência escolar também se constitui, por outro lado, em estratégia de resistência, e a FICAI pode ser uma possibilidade de detectar outras situações de violações de direitos na escola e na rede. A FICAI, apesar de ser um instrumento que busca a garantia do direito, algumas vezes reforça a exclusão social devido à desresponsabilização dos atores da rede pelo seu preenchimento e pelo seu desconhecimento. Como resultado, temse que a FICAI se constitui como um mecanismo perverso ao reproduzir práticas de exclusão, culpabilização, punição que acabam acompanhando o processo, que vai perdendo seu sentido protetivo. Conclui-se que os instrumentos criados para a garantia de direitos apresentam, na sua operacionalização, possibilidades e limites que exigem ampliação da esfera pública e medidas que fortaleçam espaços de atenção integral às crianças e adolescentes e suas famílias. Como sugestão, recomenda-se que sejam melhor articulados e esgotados os encaminhamentos realizados pela rede de proteção do direito à educação em sua primeira instância, as escolas, antes do acionamento do Conselho Tutelar e dos órgãos de defesa, como é o caso do Ministério Público. A infrequência é uma questão complexa, devido à diversidade das situações que a constituem e de sua complexidade. Assim, não haverá soluções simples. As soluções a serem buscadas devem ser intersetoriais e de fortalecimento da esfera pública em todas as instâncias do sistema de garantia de direitos.
This dissertation discusses the challenges and limits of mechanisms that protect the right to education of children and adolescents with infrequent attendance in schools of Porto Alegre. The main goal that guided the study is the analysis of the possibilities and limits of the mechanisms that protect the right to education of children and adolescents institutionalized through the so-called Notification Card for Students with Irregular School Attendance (FICAI – Ficha de Comunicação de Aluno Infrequente), with the purpose of contributing to guarantee this fundamental right. The research project is an exploratory and qualitative study guided by the dialecticalcritical method. Its empirical basis was the attendance of meetings of FICAI’s Permanent Discussion Forum by the researcher, a documental analysis of FICAI cases brought to the Prosecutor’s Office in March 2007 and interviews with the various actors involved: children, adolescents and family members affected by FICAI and professionals who participate in the Forum. The results show that irregular school attendance by children and adolescents involves issues that are often concealed – situations of exclusion experienced on a daily basis in terms of social inequality, basic needs of food, sanitation, housing and others that are not met. On the other hand, irregular school attendance is also a strategy of resistance, and FICAI might make it possible to detect other violations of rights at school and in the protection network. Although FICAI is an instrument designed to guarantee a right, it sometimes reinforces social exclusion because it does not render the network’s actors accountable for the correct filling in of the card and because of their lack of knowledge. As a result, FICAI ends up being a perverse mechanism by reproducing practices of exclusion, blaming and punishment that accompany the process, which then loses its protective meaning.The dissertation concludes that the instruments created to guarantee rights show, in operational terms, possibilities and limits that demand a broadening of the public sphere and actions designed to strengthen spaces of holistic care of children, adolescents and their families. It suggests that the protective resources in the schools themselves should be better explored and exhausted before bringing the cases to protection agencies such as the Prosecutor’s Office. Irregular school attendance is a complex issue because of the diversity of situations that it involves. Thus there will be no easy solutions. The solutions to be looked for must be of an inter-sectoral character and strengthen the public sphere at all levels of the system of protection of rights. |
