Pais homicidas e inimputabilidade: um estudo transdisciplinar

Abstract

This work tries to analyze the issue of filicide under the transdisciplinary view, trying to identify the cases, the reasons, the way that it is most used by parents who kill their own children. The relationship between the nonimputability and filicide is also the target of this discussion, the mental disorders that are most current and the form of prevention, equally being transdisciplinary. This present work is linked to the line search of “Criminology and Social Control” (Criminologia e Controle Social) from the area that works on “Penal System and Violence” (Sistema Penal e Violência) which comes from the Post Graduation Program on Criminal Science at Universidade Católica do Rio Grande do Sul (PUCRS). Starting from a transdisciplinary justification, a summary is made about the filicide practice. Going this direction, the evil, intrafamily violence, filicide and the evolution of society is discussed. Next, filicide is observed under the judgment of Law, highlighting the criminal justice treatment throughout the years, the puerperal condition, the nonimputability and the forensic expertise. Therefore, the psychiatric focus of the subject matter is done with the use of vignettes gathered while a research was done in the Mauricio Cardoso Forensic Psychiatric Institute (Instituto Psiquiátrico Forense Maurício Cardoso), observing the relationship between the mental illness or disorder and criminality, the filicide practice and the maternal and paternal filicide. This work highlights the need on the combination of knowledge as a way to study and prevent something as complex and multifaceted as the filicide. Even, because the very complexity of the human being enables recognition of its diversity and uniqueness. At the same time the human being is multiple, it is also part of a unity in a society with several dimensions.

A presente dissertação busca a análise da temática do filicídio sob a ótica transdisciplinar, visando à identificação dos casos, os motivos e a forma mais frequentemente utilizada pelos pais filicidas. Também são alvos desta discussão a relação existente entre a inimputabilidade e o filicídio, os transtornos mentais mais recorrentes e a forma de prevenção, todos igualmente enfocados sob forma transdisciplinar. Vincula-se a presente dissertação à linha de pesquisa “Criminologia e Controle Social”, da área de concentração “Sistema Penal e Violência”, do Programa de Pós-Graduação em Ciências Criminais, da Faculdade de Direito da Pontifícia Universidade Católica do Rio Grande do Sul. Assim, partindo de justificativa transdisciplinar, é feito um apanhado histórico acerca da prática filicida. Nessa direção, discorre-se sobre o mal, a violência intrafamiliar e o filicídio e a evolução da sociedade. Em seguida, observa-se o filicídio sob a ótica do Direito, destacando-se o tratamento penal brasileiro ao longo dos tempos. Posteriormente, são abordados o estado puerperal, a inimputabilidade e a perícia médico-legal. Por conseguinte, é realizado o enfoque psiquiátrico do tema, com uso de vinhetas colhidas durante pesquisa feita no Instituto Psiquiátrico Forense Maurício Cardoso, observando-se a relação entre doença mental e criminalidade, o ato filicida e os filicídios materno e paterno. Este trabalho evidencia a necessidade acerca da conjugação dos saberes como forma de estudar e, principalmente, prevenir ato tão complexo e multifatorial como o filicídio. Até mesmo, porque a própria complexidade do ser humano possibilita o reconhecimento de sua diversidade e singularidade. Ao mesmo tempo em que é múltiplo, o ser humano também faz parte de uma unidade, de uma sociedade com várias dimensões.
