| Resumen: | O objetivo da presente dissertação consiste em analisar como se vem constituindo o sistema de garantia dos direitos humanos à população migrante na cidade de Porto Alegre, a fim de identificar os desafios e possibilidades para a efetivação e a defesa dos direitos humanos desse segmento social. Instituiu-se como um estudo de natu-reza qualitativa, de caráter descritivo e exploratório, fundamentado no método-dialético crítico de Marx. Para a coleta de dados, utilizou-se de fontes documentais e bibliográficas, além de entrevistas semiestruturadas com 07 profissionais dos eixos de defesa, controle e promoção do sistema de garantia de direitos à população mi-grante de Porto Alegre. A análise dos resultados obtidos foi sucedida pela análise de conteúdo em Bardin.Os resultados alcançados possibilitaram desvelar a realidade do sistema de garantia de direitos aos migrantes de Porto Alegre, demonstrando o caráter (des) protetivo e (des) responsável que o Estado tem com esse segmento social frente à conjuntura neoliberal. Observa-se que, devido ao contexto de precarização e esgotamento que vêm sofrendo as instituições e políticas públicas do sistema de garantia de direitos, as ações desenvolvidas pelos serviços públicos são insuficientes para o atendimento de todas as demandas e necessidades complexas da população migrante. Mediante tal situação, há o fortalecimento de ações da sociedade civil na temática das migrações, através do cunho assistencialista, focalista e humanitário, além de parcerias entre os setores público e privado. Embora se identifique, na conjuntura de desmonte de direitos, inúmeras barreiras e desafios diários para a efetivação do sistema de garantia de direitos, também se verificam estratégias e possibilidades de resistência frente aos processos violadores de direitos dos migrantes, como é o caso do fortalecimento dos espaços de controle social, a articulação intersetorial entre os serviços, o esforço no planejamento de ações, entre outras questões.
The objective of this dissertation is to analyze how the system of guaranteeing the human rights to the migrant population in the city of Porto Alegre has been constituted, in order to identify the challenges and possibilities for the realization and the defense of the human rights of this social segment. It was instituted as a qualitative, descriptive and exploratory study, based on Marx's critical dialectical method. For data collection, we used documentary and bibliographic sources, as well as semi-structured interviews with seven professionals from the defense, control and promotion of the rights guarantee system to the migrant population of Porto Alegre. The analysis of the results obtained was succeeded by content analysis in Bardin.The results achieved made it possible to unveil the reality of the system of guaranteeing rights to migrants from Porto Alegre, demonstrating the (un) protective and (un) responsible character that the state has with this social segment in view of the neoliberal conjuncture. Due to the context of precariousness and exhaustion that the institutions and public policies of the rights guarantee system have been suffering, the actions developed by the public services are insufficient to meet all the complex demands and needs of the migrant population. Through this situation, there is the strengthening of civil society actions on the theme of migration, through the assistance, focus and humanitarian nature, as well as partnerships between the public and private sectors. Although in the context of the dismantling of rights, numerous barriers and daily challenges to the implementation of the rights guarantee system are identified, there are also strategies and possibilities of resistance to the processes that violate the rights of migrants, such as the strengthening of rights. spaces of social control, intersectoral articulation between services, effort in action planning, among other issues. |
