| Abstract: | Este trabalho tem por objetivo questionar o interesse da sociedade na manutenção do atual sistema carcerário, visto que os índices de reincidência indicam falha no processo de reabilitação, o que leva a especialização e aumento do crime nas suas diferentes formas. Neste estudo, tendo em vista seu questionamento, aborda-se as funções do poder punitivo e como ele se configura na atualidade brasileira, articulando-se a vertentenses políticas radicais, tais como o autoritarismo e o fascismo. Para tanto, é conferida ênfase aos conceitos das funções do poder punitivo, como ele foi empregado no período ditatorial, suas articulações com movimento fascista e como isso reflete na sociedade atual. Além dos conceitos estudados, este trabalho utiliza dados quantitativos que mostram índices que fundamentam o argumento empregado, o não funcionamento das funções de ressocialização e o impacto do fascismo sobre o poder punitivo. Este trabalho, contudo, não se prende apenas a instituições carcerárias, mas sim à punição de maneira mais abrangente e seus possíveis efeitos sociais.
This paper aims to question society's interest in maintaining the current prison system, since the recidivism rates indicate a failure in the rehabilitation process, which leads to the specialization and increase of crime in its different forms. In this study, in view of its questioning, we address the functions of punitive power and how it is configured in the Brazilian present time, articulating itself to radical political views, such as authoritarianism and fascism. To this end, emphasis is given to the concepts of the functions of punitive power, how it was employed in the dictatorial period, its articulations with the fascist movement, and how this reflects on society today. In addition to the concepts studied, this work uses quantitative data that show indexes that substantiate the argument employed, the non-functioning of the functions of resocialization and the impact of fascism on punitive power.
