| Resumo: | O presente estudo tem como principal objetivo abordar a inovação legal trazida com a inserção da Lei n.º 14.382/2022, destinada à regulação dos serviços prestados junto às serventias registrais brasileiras. Neste caso, dando especial enfoque às novas possibilidades de alteração que poderão ser aplicadas ao nome registral, um direito de todas as pessoas naturais, sem exceção, devendo o nome ser adotado no ato registral que caracteriza o nascimento, através da emissão da Certidão de Nascimento e garantindo todos os direitos a estes inerentes. Sendo que as alterações abordadas neste artigo vêm principalmente no sentido de não haver necessidade da comprovação de motivação específica para a alteração do nome e de forma totalmente administrativa, o que anterior a esta inserção legislativa, não era possível. Somente ocorriam alterações mediante a apreciação e julgamento da demanda pelo Poder Judiciário, o que por vezes tornava difícil o acesso da população geral, fosse por desconhecimento, falta de tempo ou mesmo de motivação adequada à discricionariedade do julgador. Atualmente, tornou-se um tanto quanto mais acessível e, logicamente, servindo como uma ferramenta a mais no âmbito administrativo para que impacte de forma positiva na redução de demandas judiciais, deixando somente complexidades maiores passíveis da devida prestação jurisdicional. Assim, garantindo o devido cumprimento dos Direitos Fundamentais, como a dignidade da pessoa humana em relação a direitos da personalidade.
The main objective of this study is to address the legal innovation brought about by the insertion of Law number 14.382/2022, destined to the regulation of services provided by Brazilian registry services. In this case, giving special focus to the new possibilities of alteration that may be applied to the registered name, a right of all natural persons, without exception, and the name must be adopted in the registration act that characterizes the birth, through the issuance of the Birth Certificate, making each person become a citizen, and guarantee all the rights inherent to them. Since the changes discussed in this article come mainly in the sense that there is no longer a need to prove specific motivation and in a completely administrative way, which prior to this legislative insertion was not possible. Alterations only occurred through the appreciation and judgment of the demand by the Judiciary, which sometimes made it difficult for the general population to access, whether due to lack of knowledge, lack of time or even adequate motivation at the discretion of the judge. Currently, it has become somewhat more accessible and, logically, serving as one more tool in the administrative sphere so that it has a positive impact on the reduction of legal demands, leaving only greater complexities subject to due jurisdictional provision. Thus, guaranteeing the due fulfillment of Fundamental Rights, such as the dignity of the human person in relation to personality rights. |
