| Abstract: | O presente estudo propôs-se investigar, observar e descrever os processos de trabalho dos Assistentes Sociais Judiciários, com vistas a apreender os desafios e limites na contribuição da garantia de direitos para as relações familiares que demandam ao Judiciário. Isso porque as famílias que vivenciam conflitos em suas relações tendem a recorrer cada vez mais às instituições públicas para garantir direitos por meio de leis. Diante desse contexto, formulou-se, para este trabalho, o seguinte problema: quais as demandas por garantia de direito das famílias que acorrem ao Judiciário de Porto Alegre/RS e como essas demandas são respondidas pelo Estado e, nele, pelos Assistentes Socais do Foro Central? A construção da pesquisa alude a uma abordagem qualitativa, com base na experiência de vida dos sujeitos, nas relações sociais e no significado que por eles é atribuído a essa garantia. Para as entrevistas realizadas com os Assistentes Sociais do Judiciário, foi empregada a técnica de grupos focais. Buscou-se identificar assim os meios utilizados por esses profissionais para romper e ultrapassar limites colocados no cotidiano da prática profissional, a fim de que esses não reproduzam as relações sociais que se encontram legitimadas na atual sociedade brasileira.Com relação às famílias, além da análise documental disponível no judiciário, realizaram-se entrevistas nas residências das quatro famílias que consentiram em participar da pesquisa. A análise das entrevistas realizadas com as famílias, Juízes e Assistentes Sociais do Judiciário ocorreu na perspectiva da leitura do contexto contemporâneo no marco das transformações que vêm alterando a organização social, econômica, política e cultural nas sociedades capitalistas. Os resultados apontam que o Estado no processo de garantir direitos oferece uma proteção superficial e formal que ocorre por meio da aplicação de leis para redirecionar os conflitos familiares. O Judiciário, ao resolver as situações pelos mecanismos regulatórios nas relações familiares, não alcança a complexidade das desavenças, ressentimentos, mágoas, carências e necessidades dos sujeitos em suas relações. A superação desses limites supõe o estabelecimento de atitudes críticas da parte dos profissionais, enquanto agentes éticos, de avançarem em suas práticas, no compromisso com a democracia, na garantia da realização dos Direitos Humanos.
The actual study intends to investigate, to observe and to describe the Judiciary Social Workers working process, with the intention to apprehend the challenges and limits in the contribution of the rights guarantee for the families relations that demand to the Judiciary. This, because the families that live with struggles in their relations, tend to appeal more and more to the public’s institutions to guarantee rights through the laws. In face of this context, it was formulated to this work the following issue: Which demands by rights guarantee of the families that ask help to Porto Alegre/RS Judiciary and how are they responded for the estate and, in it, for the Foro Central Social Workers? The construction of the research was referred to a qualitative approach based on the experience of the people’s life, in the social relations and in the meaning, in which are attributed this guarantee. To the accomplished interviews the Judiciary Social Workers was employed the grupo focais technique. Searching to identify the useful middles by these professionals to brake and exceed the placed limits in the quotidian professional practice, intending that these ones don’t reproduce the social relations that was found legitimized in the actual Brazilian society. Related with the families, besides the available documental analyses in the Judiciary, was accomplished interviews in four families houses that have agreed to participate in the research. The analyses of the accomplished interviews with the families, the Judges and Social Workers, occurred in the perspective of reading the actual context in the event of the transformations that came changing the social , economic, political and cultural organization in the capitalists societies.The results point that the Estate in the rights guarantee process offers a formal and superficial protection that occurs by the laws application to redirect the families struggles. The Judiciary to resolve the situations by regulatory mechanisms in the families relations, don’t reach the complexity of discords, resentments, sorrows, needs and people’s necessities in their relations. The overcoming of these limits supposes a critical attitudes establishment by the professionals, while ethical workers, to advance in their practices, in a commitment with democracy, in the accomplishment of the Human Rights guarantee. |
