Abstract: | The purpose of the present study consists of the examination of the effectiveness of the Inter-American Court of Human Rights sentences. In order to make it possible, the deductive method has been used with the approach of a bibliographic and documental research, in a way of bringing back qualitative data capable of offering satisfactory results to the research. Regarding the need of a total fulfillment of the sentences delivered by the international courts, in terms of lack of respect for human rights, raises the following question: how well is the Brazilian judicial review effective in relation to the sentences delivered by the Inter- American Court of Human Rights? It does a comparison of the most emblematic cases of Brazil, Chile e Argentina, because of the similarities among them of a dictatorial past and the proximity of them, to then, bring a conclusion if there is efficiency on the sentences done by the ICHR in Brazil. O presente trabalho objetiva o estudo da eficácia das decisões das sentenças de direitos humanos proferidas pela Corte Interamericana de Direitos Humanos. Para a execução da presente pesquisa, utilizou-se o método dedutivo de abordagem com pesquisa bibliográfica e documental, de modo a retornar dados qualitativos capazes de apresentar resultados satisfatórios para a pesquisa. Tendo em vista a necessidade do cumprimento de forma integral das decisões proferidas pelas Cortes internacionais, no que tange ao desrespeito aos direitos humanos, surge o seguinte questionamento: em que medida o controle jurisdicional de convencionalidade brasileiro é eficaz em relação às decisões proferidas pela Corte Interamericana de Direitos Humanos? Faz-se um comparativo entre os casos mais emblemáticos do Brasil, Chile e Argentina, dada a semelhança entre estes de um passado ditatorial, para então concluir se há eficácia nas decisões da Corte IDH proferidas no Brasil. |
