| Abstract: | A presente dissertação analisa o processo penal como cerimônia de degradação do indivíduo, sob a perspectiva dos rituais, o qual tem o tempo como irreversível, sendo extremamente difícil encontrar o equilíbrio dinâmico necessário. Para tanto, são abordados os ritos e rituais contemporâneos, entre eles, os rituais religiosos, os profanos e o ritual de passagem e os símbolos dos rituais. Em seguida, analisa-se o ritual judiciário do processo penal. Tratando o processo penal como ritual de reconstrução do fato histórico, como ritual de passagem, são apresentados os papéis dos atores — juiz, Ministério Público, Defesa, réu —, o arquétipo da Justiça, o espaço judiciário, o traje ritual e a temporalidade do ritual. Ao final, é debatida a problemática da degradação do status e da estigmatização social e jurídica do indivíduo submetido ao processo penal. Verificou-se a influência do estigma em relação à Teoria do Labelling Approach e ao Princípio da Dignidade da Pessoa Humana. Por derradeiro, examinou-se o ritual judiciário do processo penal e sua relação com a degradação do indivíduo e a simbologia do sacrifício. O tema foi tratado em três capítulos, tendo sido utilizado o método analítico, por meio de uma pesquisa interdisciplinar de obras estrangeiras e nacionais.
The present dissertation analyzes the criminal proceeding as ceremony of degradation of the individual, under the perspective of the rituals, which has the time as irreversible, being extremely difficult to find dynamic the balance necessary. For in such a way, the rites and ritual contemporaries are boarded, between them, the religious rituals, profane and the ritual of ticket and the symbols of the rituals. After that, the judiciary ritual of the criminal proceeding is analyzed. Treating the criminal proceeding as ritual to reconstruction of the historical fact, as ritual of ticket, the papers of the actors — judge, Public prosecution service, Prohibited, male defendant —, archetype of Justice, the judiciary space, the ritual suit and the temporality of the ritual are presented. To the end, the problematic one of the degradation of the status and the social and legal estigmatização of the individual submitted to the criminal proceeding is debated. It was verified at the outset influence of the stigma in relation to the Theory of the Labelling Approach and of the Dignity of the Person Human being. For last, one examined the judiciary ritual of the criminal proceeding and its relation with the degradation of the individual and the symbology of the sacrifice. The subject was treated in three chapters, having been used the analytical method, by means of a research to interdisciplinary of foreign and national workmanships. |
