A repersonalização da posse no Código Civil de 2002 e uma análise paradigmática com o Código Civil de 1916 à luz de uma releitura hermenêutico-sistemático constitucional

Abstract

O presente estudo objetiva mostrar a necessidade de fazer-se uma releitura do instituto da posse previsto no Código Civil de 2002, com base em análise paradigmática do Código Civil de 1916, superando-se o modelo codificado liberal, a partir de uma perspectiva fundada na re-interpretação hermenêutico-sistemática constitucional aberta e completável, onde o fundamento jurídico-social seja a pessoa humana e não o indivíduo patrimonialista.

This actual study aims to demonstrate the necessity of making a new reading of the ownership institute foreseen in the 'Código Civil de 2002', with bases in a pragmatic analyze of the 'Código Civil de 1916', surpassing the liberal codified model, from a perspective fund on the reinterpretation hermeneutic systemic open constitutional and compatible, where the juridical-social fundament is a human person and not a patrimonial individual.
